Hosting Services Agreement

The services that are on the EuroVPN website (https://eurovpn.org/) are provided by EuroHoster Ltd.
These General Terms and Conditions are designed to regulate the relations between EuroHoster Ltd., 5 St. Cyril and Methodius str., 1st floor, office 3, Burgas, Bulgaria, UIC 203451640, represented by Mr. Andriy Balitsky, hereinafter referred to as the Provider, and the users, hereinafter referred to as Clients, of the services provided by him.

1. Information about the Service Provider

1.1. Name of Provider: EuroHoster Ltd.
1.2. Headquarters and address of management: 5 St. Cyril and Methodius str., 1st floor, office 3, Burgas, Bulgaria

2. Characteristics of the "VPN"

2.1. The Provider undertakes to provide to the Client for use the VPN (virtual private network), service in accordance with the specifications determined according to the plan chosen by the Client and to ensure the connectivity and technical service of the provided service. The VPN service includes the following:
2.1.1. providing configurations to the Client for creating a secure Internet connection (encrypted tunnel) using the WireGuard application;
2.1.2. providing service parameters according to the subscription plan chosen by the Client;
2.1.3. provision of a technically serviceable service.

3. It is prohibited using "VPN"

3.1. spam sending;
3.2. distribution of pirated and/or malicious software, serial numbers for programs, software hacking tools, as well as links to other sites with similar content;
3.3. distribution of viruses, exploits, botnets, and links to other websites with similar content;
3.4. use our technical capabilities to organize DoS attacks, network scanning, flood attacks;
3.5. distribution of zoophilia and child pornography content;
3.6. distribution of content that promotes cruelty, violence, war, racial or religious hatred;
3.7. use our technical capabilities to distribute and/or advertise illicit substances;
3.8. distribution of any pornographic materials using VPN located in Bulgaria;
3.9. distribution of other illegal content that violates law.

4. Usage of "VPN"

4.1. Use of VPN is allowed only for personal purposes.

5. Violation of the Agreement

5.1. Upon detection of a violation of the Agreement, the Client is sent a notice with a specified deadline for elimination of the incident.
5.2. The service will be blocked if repeated complaints concerning the same violation will be received.
5.3. The Provider has the right to refuse the provision of services for multiple violations of the Hosting Services Agreement
5.4. All services of the Client are blocked upon detection of the fact that the Client has registered an account for fictitious data, until the issue is resolved.
5.5. The Provider reserve the right to determine the fact of violation of the Agreement.

6. Disclaimer

6.1. The VPN service is provided "as is" and "as available", without warranty of any kind, either express or implied, including but not limited to the implied warranties of fitness for a particular purpose.
6.2. The Provider assumes no responsibility for any and all lost profits, or other losses incurred as a result of the suspension of services for the reasons described on this Agreement.
6.3. Appeals to the Technical Support from e-mail addresses not registered in the system are not prioritized and are not mandatory for consideration.
6.4. The Provider does not take part in disputes with third parties.

7. Removing Services

7.1. In case of non-payment of bills by the Client for more than 15 days, the VPN service shall be deleted.

8. Technical Support Obligations

8.1. React to the performance of VPN services issues.
8.2. Advise Clients about the settings of WireGuard clients.
8.3. The Technical Support shall not:
8.3.1. provide technical support to individuals who are not clients of the Provider;
8.3.2. provide training for working with the software;
8.3.3. answer questions not directly related to the obligations of the Technical Support

9. Client Verification

9.1. The Client is obliged to indicate the correct personal data in the profile on the Provider's website and keep them up to date.
9.2. The Provider has the right to request the verification of the Client’s telephone number by sending an SMS or a voice call with a verification code.
9.3. In case of reasonable doubt in the accuracy and completeness of the Client's data, the Provider has the right to initiate the procedure of verification of personal data in order to confirm the identity of the Client.
9.4. The Provider has the right to refuse to provide services, including those previously activated, in case of the Client’s refusal to provide true personal data or refusal to verify by phone.
9.5. The Client is given 72 hours to provide correct personal data and to verify it. After the rendered period, the Provider shall be entitled to suspend the Services until the Client resolves the matter. The compensation for the period of the Service stoppage or the change in the term of the Services is not performed by the Provider.
12. Other points not listed in the Agreement shall be governed by the Knowledge Base and the current legislation.
13. All data, such as Client's personal information, correspondence between Clients and Provider, are strictly confidential and cannot be transferred to third parties, except as required by law.
14. By agreeing to these rules, the client agrees not to participate in any legal proceedings or claims against the Provider.
15. The Provider has the right, at its sole discretion, without giving notice and without due compensation to unilaterally terminate this Agreement if it finds that the services provided are used in violation of the legislation in the Republic of Bulgaria.
